Service Charges
When a sale of a property is to take place BHP Ltd does not apportion service charge payments or any credit on the sellers account as between a buyer and seller. It is possible that there is up to a 6 month advance payment of service charge as well as a sum of money in the sellers owners account at any one time.
This is a matter for the parties to resolve between themselves, on an assignment the control of the owners account will otherwise pass to the buyer by default.
Restriction on Land Registry Title Register
The title to each property contains a restriction on the Proprietorship Register requiring the consent of BHP Ltd to a change of ownership. On a sale of a property it is a condition of issuing the Deed of Covenant that there are no arrears of service charge.
We will check the position when sending the Deed for signature on behalf of the Company. Sometimes there is a delay in obtaining confirmation of a payment near a payment date as bank statements have to be obtained and checked.
